Regulatory framework

As Crown corporations, ATB Financial and its subsidiaries operate under a legal framework established pursuant to the provisions of the ATB Financial Act and ATB Financial Regulation. This legislation was modelled on the legislation governing other Canadian financial institutions and is amended periodically. ATB Financial also operates within the legal framework established by such statutes of general application affecting the operations of provincial Crown corporations such as the Financial Administration Act, Government Accountability Act and Alberta Public Agencies Governance Act and applicable legislation dealing with consumer protection, privacy and mo​ney laundering. ATB Financial’s investor services subsidiaries are also subject to regulatory oversight by the Investment Industry Regulatory Organization of Canada and the Alberta Securities Commission.

A Mandate and Roles document entered into between the President of Treasury Board and Minister of Finance and ATB Financial provides guidance to ATB Financial in conducting its affairs further to the ATB Financial Act and ATB Financial Regulation.

In addition to the ATB Financial Act and ATB Financial Regulation, ATB is subject to regulatory oversight by the Alberta Superintendent of Financial Institutions who, on behalf of the President of Treasury Board and Minister of Finance, has issued the following Guidelines and Ministerial Order, (similar to those issued by the Office of the Superintendent of Financial Institutions that supervises federally regulated deposit-taking institutions):
